TERMS OF SERVICE
Customer agrees when using, or accessing goviphosting.com services that
the following terms and conditions of this policy will be met:
Acceptable Usage Policy
01. User agrees to use the service in manner consistent with any and all
applicable laws. In the event that this account is not used in
accordance with all Applicable Laws including, but not limited to Local,
State or Federal Laws, goviphosting.com reserves the right to cooperate
with all or any law enforcement agencies.
02. User agrees to follow the Acceptable Use Policy of any network user
connects to, including goviphosting.com system.
03. Neither goviphosting.com nor its Information Providers are
responsible for any damages arising from User's use of goviphosting.com
or by User's inability to use goviphosting.com service.
04. User hereby agrees that any material submitted for publication on goviphosting.com through user's account(s) does not violate or infringe
any copyright, trademark, patent, statutory, common law or proprietary
rights of others, or contain anything obscene or libelous. Software
intended to facilitate any such violations or infringements may not be
stored on goviphosting.com.
05. The following violations of "netiquette" are grounds for immediate
suspension of service pending investigation by goviphosting.com and
will result in termination of the account(s) the investigation
determines to have originated or transmitted these types of traffic.
(a) Posting a single article or substantially similar articles to an
excessive number of newsgroups (i.e., 20 or more) or continued posting
of articles which are off-topic (e.g., off-topic according to the
newsgroup charter or the article provokes complaints from the regular
readers of the newsgroup for being off-topic).
(b) Sending unsolicited mass e-mailings (i.e., to more than 25 users)
which provoke complaints from the recipients.
(c) Engaging in either (a) or (b) from a provider other than
goviphosting.com and using an account on goviphosting.com as a mail
drop for responses, or advertising a web site hosted at
goviphosting.com.
(d) Continued harassment of other individuals on the Internet after
being asked to stop by those individuals and by goviphosting.com.
(e) Impersonating another user or otherwise falsifying one's user name
in e-mail, Usenet postings, on IRC, or with any other Internet service.
(This does not preclude the use of nicknames in IRC or the use of
anonymous re-mailer services.)
06. Users whose accounts are terminated for any of the above infractions
are also responsible for the cost of labor to cleanup and respond to
complaints incurred by goviphosting.com.
07. User agrees to use no more than 10% of the system resources on
shared servers. If it is determined that a customers
account is utilizing more than 10% of system resources, goviphosting.com may suspend the account to prevent the server from
experiencing any issues, resulting problems to other valued customers.
If it is determined that the account is not suitable for the shared or
reseller server environment, a notice will be sent to the customer
providing them alternative solutions or such as 'Semi-Dedicated',
'Dedicated Servers' or a Premium Hosting account. goviphosting.com will
be the sole arbiter as to what constitutes a violation of this provision
and goviphosting.com reserves the right to make adjustments to these
limits at our sole discretion.
08. Disk Space and Client Content:
Disk Space is restricted by content and usage. The following content
types are not allowed on our shared web hosting packages including but
not limited to down load sites (audio, video, file/image and software downloading websites) audio or
video streaming websites; and free hosting or e-mail providers. As long
as you do not abuse the systems resources, it will be a pleasure serving
your hosting needs. A
violation of this provision will result in immediate suspension of the
account to prevent any issues for our other valued customers. If you
have any further questions or doubts please
contact us any time at our 24/7 support center and we will get back
to you immediately. Customer
is solely responsible for development, operation, maintenance of its
website, online store and/or e-commerce activities. Including but
without limitation, products and services offered online including the
accuracy, appropriateness of the content making sure that it does not
violate or infringe upon the rights of any person, is not defamatory or
otherwise illegal. Customer shall be solely responsible for accepting
processing and filling customer orders and inquiries or complaints and
is responsible for the payment of all taxes associated with its website
or online store. In addition Customer will be responsible for security
and confidentiality of customer information (including credit card
details) that they may receive as a result of their website or online
store. Customer confirms to Goviphosting.com that it owns or has the
right to use the customer content and material contained and that this
content does not and will not infringe or misappropriate any copyright,
trademark, trade secret, patent or any other property right of a third
party, or violate any criminal law or result in unfair competition,
defamation, constitute false advertising, invasion of privacy, violate a
right of publicity or any other law or regulation.
09. Bandwidth Usage Policy:
Because of the potential for abuse, Goviphosting.com has put into place
the following policy which governs the use of the bandwidth. Bandwidth
is restricted by usage. The following usage types are not allowed on our
shared website hosting packages including but not limited to audio,
video, and software downloading files; audio or video streaming files. A
violation of this provision will result in immediate suspension to
prevent any issues for our other valued customers.
10. Excessive CPU/Memory Resource
Policy: Resources are defined as bandwidth and/or processor usage.
This policy is implemented to prevent the misuse of our servers. CPU
usage on the hosting server where your account is hosted is regulated as
follows. Each account is only allowed to use a maximum 10% of the CPU
power/usage at any given time. Accounts that use above this amount or
cause the web server to slow down for any reason will be asked to reduce
the amount of load and traffic or upgrade to a premium hosting package
with higher resources. Even if the customer upgrades we reserve the
right to lock specific files or scripts that are found to still be
overusing the CPU on their own and notify you of this. If this issue is
not resolved promptly Goviphosting.com reserves the right to suspend or
terminate an account without a refund if we feel that an account is
jeopardizing our network and hence violating our TOS. Goviphosting.com
will remain the sole arbiter as to what constitutes a violation of this
policy. 11.
Non Legal Activity: Goviphosting.com hosting advises that its
services may only be used for lawful purposes. Any actions by any
account holder at Goviphosting.com that violates state, federal, local
or international laws are strictly prohibited and will result in
immediate removal of this customers account, including any files stored
in the account. The following activities listed, but not limited too are
forbidden at Goviphosting.com and will result in immediate dismissal of
all customer accounts and files; if you host or serve any material that
contains threatening, unlawful, abusive, obscene, offensive or material
Goviphosting.com finds inappropriate, hosting unlicensed software that
is available to public, software or files that contain viruses or harm
user’s computers, sending unsolicited or prohibited advertisements, or
mass emails, attempt to use any account without the current owners
authorization or any attempts to “internet scam” will all result in
actions being taken against the account holder which may include but are
not limited to: warnings, account suspension or termination or legal
action. Any accounts terminated for violating Goviphosting.com TOS will
not be eligible for any refund. 12. Backup
Files: Goviphosting.com goes out of its way to protect and backup
data both daily and weekly. This backup of data is a value added service
for our customers; Goviphosting.com does not guarantee this feature and
therefore recommends that customers also back up their data daily.
Requests for our administrators to retrieve individual customer’s
back-up files can be made, but will be subject to our one time admin fee
of $50.00.
Payment Issues
01. User agrees to pay goviphosting.com all charges relating to the use
of User's account(s) according to rates and prices stated on said sales
order at the time of commencement.
02. User is responsible for charges at the time the service is used and goviphosting.com may apply the amount due to User's credit card at any
time.
03. goviphosting.com reserves the right to suspend access to service
for User's account(s) upon an indication of credit problems including
delinquent payments or rejection of any credit card charges.
04. Dues must be paid on a timely basis. Dues charges will continue
regardless of your use unless and until you notify us via e-mail that
you wish to cancel your membership at the end of your contract period.
30 days cancellation notice prior to the end of your current term is
required. You can cancel your membership within your first 30 days and
receive a full refund on your monthly fees. Domain Registration, Domain
Transfer and Setup Fees are non-refundable!
05. Credit Card payment: If Customer chooses to pay for services by
credit card, Customer grants goviphosting.com Internet Services the
right to charge payments to that card on each due date. Customer further
agrees not to challenge nor dispute any charge representing hosting
payments.

1st month Free hosting offer is valid for the 1st 30 days (thirty) from
the date account is set up.
To activate any hosting plans under this special VIP offer, customer
must complete registration including agreeing with Goviphosting.com
Terms of Service and providing credit card information.
When you buying hosting from us, we will waive the 1st month hosting
fees and it will display on the shopping cart as "Startup Fees" and
there will be a charge of $0.02 (cents) from you, since there should be
some valid amount in order to process the transaction and verify your
card details.
If the account is not cancelled before the first 30-day period ends, the
account will convert to a paid status and the credit card entered during
the registration process will be billed the applicable regular monthly
service fees.

30 day Money Back Guarantee
30 day money back guarantee is subjected to merchant account fees. This
is the fee that we will have to pay to our payment processor for
processing the payments. Therefore all refunds are made after deducting
this fee. Currently this fees stands at 5.5% + $0.45 from the total
transaction.
Free domain for life offer - This offer is valid for VIP-Budget,
eCommerce and supper hosting plans only. A customers will
be eligible for this offer when he/she signup with above mentioned hosting plans under

charge. And your not allowed to remove this link under any
circumstances, violation of this condition will lead to immediate
suspension of your hosting account. Multimedia audio, video, and
executable files are not supported with this hosting plan. Flash files
are supported as long as they are published within an HTML page. Direct
linking is not permitted.

Customer agrees to set a link back to our site from his/her index page.
Agreement
13. goviphosting.com may modify these terms and conditions upon notice
published Online via goviphosting.com. User's use of goviphosting.com
services after such notice shall constitute User's acceptance of the
modifications to this Agreement.
14. This agreement, User account, contract, and billing will
automatically renew unless canceled in writing 30 days prior to the
